ATF case# 93245 86 4035T Salt Lake City Utah. Also re surrender of Machine gun serial ARB 0161 Model A180 Manufactured by American Research Co Salt Lake City Utah registered to Bernard Braham NFA ID# 6595 Registered with BAFT NFA branch Washigton DC on ATF form 3 on 10 April 86. As I stated to you, on 6 Nov 86 special agent Jack Malooly, ID#183, Chicago branch BAFT, acting on a request by special ATF agent Bower Salt Lake City, Utah, came to my residence and requested to examine the above firearm. He determined that is was needed for evidence in a possible court action against American Research. He informed me that the firearm showed signs of having been altered and that although he was not going to seize it from me as I was an innocent victem of a possible crime, he had the power to do so. He asked me to surrender this firearm to him, which I did and he gave me a receiot for it. In a conversation with agent Bower I was assured that regardless of the outcome ATF would ask the court to order my firearm returned to me, as it was legally purchased and correctly transferred to me by NFA branch. It is currently being kept in the evidence vault of ATF Chicago. I would appreciate that where possible you assist me in recovering my property once it's need as evidence is over, or in the event that the case is not prosecuted. Even if there is a conviction ATF agent Bower said that ATF would request the court order my property returned. I would appreciate that the prosecutors office go along with that request on my behalf if for some reason of oversight ATF fail to make the request. I have cooperated as best I can with ATF in this matter and they in turn have been considerate of my situation but I am out considerable amount of money since the fair market value of this firearm is in the area of $2500 and I respectfully request the court not to penalise me in this action.
